Asthma compensation claim success stories

CASE STUDY 1

Mr R lived near Manchester and worked in a factory doing assembly work. 

The factory was of an open plan design, and this allowed dusts, gases and fumes to contaminate the air throughout the factory.

Unfortunately, the air extraction system to get rid of contaminated air in the factory was not properly working, and Mr R was breathing in fumes and vapours from the soldering and work processes done in his work area. 

As a consequence Mr R developed occupational asthma and had to take sick leave from work. 

The insurers of the factory owners paid Mr R £24000 asthma compensation for developing the condition due to the factory being in breach of the Control of Substances Hazardous to Health Regulations (COSHH).  

CASE STUDY 2

Mr E lived in Cleveland and worked for a firm who did repair work to heavy goods vehicles, coaches and buses. 

Mr E was a paint sprayer and painted the bodies of the vehicles after they had been repaired.  In breach of legal duties owed to Mr E under the Control of Substances Hazardous to Health Regulations (COSHH) the owners of the firm caused Mr E to work in a garage that did not have an air ventilation system to deal with the paint vapours and fumes.  The claimant suffered with a serious respiratory disease and made a work related asthma compensation claim.

Mr E was also not provided with a suitable respirator or personal protective equipment.  The insurers of the owners of the firm paid Mr E £32000 compensation in settlement of his claim.
