Mr E lived in Cleveland and worked for a firm who did
repair work to heavy goods vehicles, coaches and buses.
Mr E was a paint sprayer and painted the bodies of
the vehicles after they had been repaired. In breach of
legal duties owed to Mr E under the Control of
Substances Hazardous to Health Regulations (COSHH) the
owners of the firm caused Mr E to work in a garage that
did not have an air ventilation system to deal with the
paint vapours and fumes. The claimant suffered with a
serious respiratory disease and made a

Mr E was also not provided with a suitable respirator
or personal protective equipment. The insurers of the
owners of the firm paid Mr E £32000 compensation in
settlement of his claim.
