Do you have to go to court to win compensation?
Most people think they might have to sue the responsible party or go to court to win their compensation.
The reality is very different.
Generally speaking we cannot say with 100% certainty that your compensation claim will not go to trial. There are various estimates and statistics that suggest the risk of going all the way to the courtroom is very slim indeed.
In our own experience it is less than 2% of cases and only 15% of claims involve the need for court papers to be issued at all.
This is not by design but purely as a result of the way the system operates. Many personal injury claims do not get anywhere near a courtroom because this can be very expensive for both sides.
But there are some claims that are less than straightforward where both sides argue over correct damages or very often liability. Regardless of the issues, it is very rare to see a case going to trial. But again we cannot say it does not happen because it does and frankly if your best interests are served in proceeding to trial then that is what we would recommend you do.
Put it into perspective, the benefits of making an accident compensation claim far outweigh the negatives and the vast majority of personal injury claims are settled out of court.
