Doctors cannot be held liable for bad advice to injured
players
The court rejected a claim for
compensation following a
doctors negligent diagnosis. The case was brought by
West Bromwich Albion, the championship club, against an
orthopaedic surgeon who treated a player worth £750,000.
The Court ruled that the doctor did not owe a duty of care
to the club and was therefore not required to compensate it
for bad advice.
Mr Appleton was signed by West Bromwich for £750,000 on a
three-year contract in 2001. He was referred to the expert,
a sports injuries specialist, after damaging his knee during
training in November that year.
The specialist gave the wrong diagnosis which led to surgery
whereas the injury could have healed on its own. The injury
worsened and the player was forced to retire..
