Slipping or falling accidents on ice at the
workplace

Here we discuss slipping accidents occurring
on land, territory or property owned or
controlled by employers:
Traffic routes in work on work premises both inside
and out are covered by the Workplace (Health, Safety and
Welfare) Regulations 1992. However, these specifically
exclude construction sites, vessels, vehicles, fishing
boats and mines.
Once again the duty imposed is one “so far as
reasonably practicable”. Whilst what is deemed to be
reasonably practicable is a matter of commonsense.
Also of assistance are the management of Health and
Safety at Work Regulations 1999. These provide guidance
as to how to carry out a “suitable and sufficient” risk
assessment and to use the same and act on them by
removing or minimising identified dangers. These may
also be specific to snow and icy conditions.
In assessing the risk the employer must look for the
hazards, decide who may be harmed and how this may
happen. The risk must be evaluated and decisions must be
made as to whether or not the existing precautionary
measures are sufficient. These findings must then be
recorded and must be reviewed and revised as necessary.
Contributory Negligence:
It is likely that there will be an allegation of
contributory negligence made in that the Claimant had
disregard for their own safety.
