CYCLING ACCIDENT CASE STUDY
The claimant was cycling along a busy main road, he
was positioned in the bike lane and was moving forward
at a steady speed. A car passed him and then suddenly
without indication turned left across his path turning
into a side road.
The cyclist had absolutely no time to stop and
collided with the passenger side of the vehicle. He fell
to the floor suffering personal injury.
The claimant was taken to hospital and discovered
that he had broken his wrist - fracturing his scaphoid
bone. He was detained in hospital for 4 hours and a
plaster cast was applied to his lower arm. He was forced
to take two weeks off work (as a factory operative) but
made excellent progress and was virtually recovered
within 3 months.
The claimant rang The Claims Connection for advice on
making a compensation claim for his personal injury. He
had an excellent case because the car driver clearly did
not see him and furthermore made indication prior to
turning. Witnesses supported the claimants version.
He would be entitled to claim the following:
Pain and suffering compensation
Treatment costs & physio costs
Recovery of personal effects (clothing costs etc)
Loss of earnings
Care and services whilst incapacitated
