If the person’s primary needs are health needs and they require full-time care either in a hospital, a care home or in their own home, then it is the responsibility of the NHS to pay for that care.

This is still the message and although many patients have not been told about this or have been wrongly informed that their loved one is not entitled to this level of care free, it still holds true and if you feel this may apply to you or a family member then it is not too late to do something about it.

The first step for those who believe they may be entitled to a refund is to contact your GP, nurse, social worker, health practitioner or local Primary Care Trust to ask for a continuing care review or an assessment which goes back to when the patient first entered the nursing or care home. If that fails there is the option of appealing the PCT’s decision or appealing to the Health Service Ombudsman. In Scotland and Wales the appeal would be to the Public Services Ombudsman. If that also fails then there is the option of asking for a judicial review if done within three months of the Ombudsman’s decision.
