The first step for those who believe they may be entitled to a refund is to contact your GP, nurse, social worker, health practitioner or local Primary Care Trust to ask for a continuing care review or an assessment which goes back to when the patient first entered the nursing or care home. If that fails there is the option of appealing the PCT’s decision or appealing to the Health Service Ombudsman. In Scotland and Wales the appeal would be to the Public Services Ombudsman. If that also fails then there is the option of asking for a judicial review if done within three months of the Ombudsman’s decision.
