(APIL) has given its full support to a parliamentary
Bill helping thousands of injured employees to claim
compensation for injuries or
disease
suffered at work, where an employer has gone bust or
insurance details cannot easily be traced The Bill,
originally drafted by APIL and introduced by Hendon MP,
Andrew Dismore, calls on the Government to set up an
employers’ Liability Insurance Bureau (ELIB) which would
act as a compensation fund of last resort for workers
who find themselves blocked from
claiming
compensation for work related injuries and diseases.
The current system is failing potential claimants
because the insurance information is not always easily
accessible and with only 3 years to claim, time soon
runs out for a legal action to be brought. Many claims
are abandoned for this reason and yet vast number of the
cases involve justified claims for compensation.
APIL were instrumental in pushing for the Bill and
the aim is to mirror the scheme operated by the Motor
Insurers Bureau (MIB) for Uninsured / Untraced driver
accidents. Here the MIB step into the shoes of an
insurer where one cannot otherwise be traced. Andrew
Dismore said his Bill was aimed at levelling the playing
field for injured workers. “If
