Travel claims Claims for accidents or injuries abroad -  including onboard an aircraft

Accidents on board an airplane  

The numbers of people travelling by airplane has increased dramatically in recent years. The introduction of cheap budget airlines has opened up a previously dormant market. This vast increase in business volumes inevitably leads to an increase in the occurrence of on-board incidents involving staff and fare paying passengers.   

If you have been injured whilst travelling on board the aircraft - whether this be in mid air or on the ground - you have certain rights as a far paying passenger.  

The 1999 Montreal Convention establishes a comprehensive and up-to-date set of rules defining and governing the liability of air carriers in relation to passengers, baggage and cargo.  

An action can be brought in your home country or permanent place of residence and the airline must be subject to the laws that exist within that jurisdiction.  

This means that regardless of whether you are in mid air or in another country (taxiing in the airport for example), once you are on board a plane the carrier is bound by the rules of the Montreal Convention.
