Woman wins compensation following fall caused by defective Stiletto heel
Dolcis shoe company to pay compensation following a personal injury claim made by a customer who fell when a stiletto heel snapped.
A woman suffered a serious leg injury when her stiletto heel snapped when she was on a night out. The shoes were brand new and hadnt been worn before yet the heel gave way and was later found to be defective. The injured victim made a compensation claim for injury.
The victim had to have an operation to correct her injury and was forced to give up her job. The case was successful primarily because Dolcis could not establish that the shoes were of "merchantable quality".
Michael Hardacre, who represented the claimant said: "In English law she was well protected under the Sale of Goods Act so it was relatively straightforward." He went on to say that in similar situations."If they have just bought the shoes and the shop admits liability they could and should take it up."
This case could lead to many more claims being brought against shoe manufacturers for defective merchandise. There are many thousands of similar tripping or falling accidents across the country. But people seldom seek legal advice following such an injury.
Dolcis went into administration in January but their holding company refused to comment on this case.
