Judicial review
Judicial review is a way for patients to challenge the decision of a public body such as an NHS organisation or the Secretary of State for Health, where he or she feels that the decision made is an unlawful one. This could be where the body making the decision may not have the power to make it, or it could be claimed that the decision is an irrational one or it is in breach of either the Human Rights Act or European Community law. Only those who have a direct, personal interest in the action concerned can make a claim for judicial review.
