MOTORCYCLIST ACCIDENT
CASE STUDY
The claimant was riding his 500cc motorbike along a
country road. The road was relatively wide and well
marked. As he approached a junction the claimant could
see another vehicle coming to a standstill at the give
way lines.
To his astonishment the claimant then saw the
vehicle move forward over the give way lines directly
into his path - a heavy collision occurred. The claimant
was thrown from his vehicle and suffered a serious leg
injury. The driver of the other car called an ambulance
and the police who were both on the scene within 20
minutes.
The other driver at first disputed that he was
at fault blaming the motorcyclist for going to fast. The
police conducted a thorough investigation and measured
the skid marks at the scene, taking full statements from
available witnesses. The claimant learned in hospital
that he had suffered a broken tibia and fibula in his
right leg. He was detained for 4 nights. Upon his
release from hospital he telephoned The Claim Connection
for advice on making a claim.
We felt he had an
extremely good case and instructed our panel solicitors
to deal with the matter on his behalf. He would be
entitled to claim the following: - Pain and suffering
compensation - Treatment costs & physio costs - Loss of
earnings.
Because of our
NO COST
NO WIN NO FEE scheme - he would not have to pay us a
penny in fees. You have nothing to lose with our
motorcycle compensation service - you pay nothing if you
win and nothing if you lose.
We argued that the other
driver in this case was completely to blame. His
allegation of speed on the part of the motorcyclist was
disregarded because the speed limit was 60mph on this
road and investigations by the police put the
motorcycle's speed at no more than 50mph. We secured a
100% liability agreement.
The claimant made a
satisfactory recovery within 2 years. We settled the
case for £10,000 for pain and suffering and secured
£3400 in other expenses such as earnings /
prescriptions, care and services etc. The motorcycle
itself was covered under the claimants own insurance
policy. Our costs were paid in full by the other drivers
insurers.
