Equal pay rights for women - unfair or low wage disputes

There remains a large pay gap in the UK between men and women’s wages. It is often cited that there is an 18% pay discrepancy with a women earning on average 82p for every £1 earned by a man.

To put that into context - during a 30 year career using an average salary of £20k per annum a female worker could earn up to £108,000 less than a male co-worker.

The equal Pay Act has been law since 1970, however, employees have proved slow to use it. Trade Unions have also been very poor in many cases at negotiating a fair settlement on behalf of their members.

The key points within the legislation The purpose of the equal Pay Act 1970 is to eliminate discrimination between men and women in terms of their pay and contracts of employment where they are doing:

  • work that is the same or broadly similar;
  • work rated as equivalent under a job evaluation study;
  • work of equal value in terms of the demands made on them under headings such as effort, skill and decision-making.

How do equal pay claims work?

The equal Pay Act 1970 implies an ‘equality clause’ into a contract of employment. This means that you have the right to be paid equally the for the work you do with someone of the opposite sex in a comparable job.

You are also entitled to equal terms and conditions with a person of the opposite sex in a comparable job.
