Cyclist who caused the death of a pedestrian
on a pavement faces jail - December 2007
A pedestrian was killed
following a collision with a
pedal bike as he walked across
the pavement.
The cyclist was said to have
been travelling at up to 25 mph
and had mounted the pavement
just seconds before making
impact.
It has to be said that
cycle accidents of this
nature are rare but the
circumstances illustrate the
importance of cycle safety and
the conduct of cyclists
generally on Britains roads.
Cyclist do get a raw deal in
many quarters but they must
accept that cycling on a
pavement is unlawful.
In this case the prosecution
was brought under the Offences
Against the Person Act 1861
which carries a maximum jail
sentence of 2 years.
The cyclist in this case had
moved onto the pavement because
the traffic on the road had
started to get heavy. He was
travelling extremely fast and
that meat he had no time
whatsoever to stop the cycle
before it hit the pedestrian.
The
fatally injured pedestrians
distraught family may have the
right to make a
compensation claim if the
cyclist had some kind of public
liability insurance.
