Rise in litigation over cosmetic surgery

Compensation claims for cosmetic surgery negligence is increasing - 20th July 2010

A growing number of people are reportedly seeking to take legal action over cosmetic surgery that has gone wrong.

There are growing calls for new laws designed to protect clients and control the quality of care given by high street clinics and some dentists who are offering the treatments.

There has been a reported rise in complaints about injections of fillers and Botox with a number complaining about hard lumps where fillers have been injected. There have also been a number of inquiries coming from patients who have suffered first-degree burns as a result of laser hair removal.

Cosmetic surgery negligence should not happen and patients need protecting and should be protected from it happening.

The Independent Healthcare Advisory Services, which represents many providers of the treatment is to launch some new rules including a registration scheme. This is to be backed by the Department of Health but is not sufficient for many critics who say that self-regulation will not go far enough in giving patients protection from poor practitioners.

In a well-known case, actress Leslie Ash suffered what has become known as “trout pout” when she suffered an allergic reaction to an implant of fillers into her lips while another BBC television presenter received a badly swollen face after laser surgery to remove acne scars.

Figures from the Independent Healthcare Advisory Service suggest that about 200,000 cosmetic surgery procedures are carried out in the UK each year and it believes that the sector grew by around 25% last year.

Monisha Coelho is among those intending to take legal action. She went to a beauty clinic in the West Midlands to receive treatment for removing body hair which cost £1,500. She received burns after the machine had been set too high and still has scarring on her leg and thigh. She said: “I now can’t spend any time at all in the sun and can’t wear clothes I like, because the scars are so prominent. It's upsetting. I feel disappointed that there are people out there who aren't properly trained and don't recognise problems when they arise. I wanted to improve my appearance, not to get burned."
