Medical negligence payouts by the NHS in England are
expected to rise by 80% next year.
As a
result of increasing numbers of successful
claims against the
NHS, the Trusts are having to adjust budgets to cope
with the surge in compensation claims. Trusts have set
aside £713m to cover costs, up from about £400m this
year.
There
has been criticism of law firms who pursue such cases
with Conservative ministers rounding on the legal
industry. Mark Simmonds, Shadow Health Spokesman said
the move to more "no win no fee" cases had increased
costs "dramatically" because it meant that
solicitors were
picking their cases carefully.
"The
proportion of
successful claims has gone up and is rising," he
said. "Legal practices are businesses and why not try
and double your income for the same amount of work."
Here
at The Claims Connection we take a different view.
Neither this nor any other law firm pursue Medical
Negligence claims frivolously. They are amongst the more
complex claims that can legally be brought. We do
carefully select which cases have merit and deserve to
be made because many patients simply wish to voice
complaints against the
NHS and have no wish to formalise this into a claim.
Nor should they be able to. However the numbers of badly
(sometimes fatally) injured victims that we encounter
week in week out in this sector, frankly are staggering.
It is
high time money was well spent on patients needs,
securing adequately resourced and fully staffed medical
teams. Until the balance is redressed there will be a
rising tide of claims against the NHS and when you deal
personally with the injured victims of medical
negligence and had some understanding of their history,
you would perhaps have more sympathy.
