To determine whether there is a claim for equal pay
you must firstly establish the comparator. You must
start by selecting someone of the opposite sex to
compare your salary to.
The person you are comparing yourself to must either
work at the same establishment as you or alternatively
be employed at a place where ‘common terms and
conditions apply’.
In either case you must be either employed by the
same employer or by an associated employer where similar
terms and conditions apply.
You do not need to be employed by the employer at the
same time as the comparator for the purpose of the
comparison.
